Substitute Federal Judge Moisés da Silva Maia, of Rio Branco, Acre, ruled against liability of the e-commerce company MercadoLivre in a case where a man, after receiving a false e-mail confirming a sale, sent a cellphone via the post office. According to the judge, the plaintiff did not exercise due care at the moment of the sale. Chalfin, Goldberg, Vainboim & Fichtner Advogados Associados represented MercadoLivre in the case.
